GBI IDs Man Killed in I-75 Chase

Jerome George “Jerry” Cundy of Woodstock led Cherokee and Cobb authorities on a chase after he allegedly robbed a Woodstock convenience store Sunday morning.

The Georgia Bureau of Investigation has identified the man killed Sunday in an as 53-year-old Jerome George “Jerry” Cundy of Woodstock.

Cundy allegedly robbed a Woodstock convenience store Sunday morning, then led Cobb and Cherokee law enforcement on a chase from a Marathon station on Bells Ferry Road in Woodstock and down I-75, to just south of the North Marietta Parkway. 

Police stopped the vehicle there, and Cundy aimed his gun at officers, who shot and killed him, the Cherokee County Sheriff's Office said Sunday.

GBI spokesman John Bankhead offered no other details in the case, which remains under investigation.

Southbound I-75 traffic was halted at the North Marietta Parkway around 11 a.m. Sunday. Lanes did not reopen until shortly after 5 p.m. Various traffic reports during the I-75 closure indicated the backup went as far north as Kennesaw, five miles away.

OCGA 17-4-20(b) Sheriffs and peace officers who are appointed or employed in conformity with Chapter 8 of Title 35 may use deadly force to apprehend a suspected felon only when the officer reasonably believes that the suspect possesses a deadly weapon or any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury; when the officer reasonably believes that the suspect poses an immediate threat of physical violence to the officer or others; or when there is probable cause to believe that the suspect has committed a crime involving the infliction or threatened infliction of serious physical harm. Nothing in this Code section shall be construed so as to restrict such sheriffs or peace officers from the use of such reasonable nondeadly force as may be necessary to apprehend and arrest a suspected felon or misdemeanant.

Now, I pose a question to those of you who question why the officers did not wait until he shot at them. If someone was pointing a gun at you, would you want the officer wait until he shot you to do something? Or would you rather they be proactive about the situation? In regards to the vest remark. Those vests only cover SOME of your vital organs. They only cover from the belly button to below the collar bone. Fun fact! They don't stop everything! You say this man had a family... So do those officers. Each day they put that uniform on (to protect those who are grateful and ungrateful) their families know there is a chance they won't be coming home at the end of shift. I thank God those officers were able to make it home to kiss and hug their family. That man knew what he was doing when he pointed his gun at those officers. How about you educate yourselves before you pass judgement. And without knowing the details of the case. I'm proud to live in a city where those cops are only a phone call away.

Well I told myself not to read all this stuff but I am glad I did. Thank you so much for your comments. There seems to be more intellegent comments than ignorant ones. Jerry was a wonderful man! He does have a huge family. Two sisters are police officers. There is more to the story than you know. Jerry was a husband, father, grandfather, brother and a great friend to many. Everyone that knew him was shocked at what happened. It just wasn't him to do this. Please for his wife of 31 years and for two of his grandchildren he was raising, PLEASE think before you spout your mouth off with mean cruel comments. To tj - I guess he does lose his right to a trial cause he is dead STUPID! To Dawg - he IS dead dead dead. To steve - you are being ignorant! To justacomment - please keep your comments to yourself! you contradicted yourself twice! You have no idea what you are talking about.

To all those that made horrible comments about my father don't even know the real story. Just to let u know the police knew it was a fake toy gun! They knew that from seeing the video camera at Walgreens where the side of the gun was missing. There was also 2 hours between the two stores. Don't u think that if he was dangerous that he would have hurt someone at those stores. Only The Lord can judge. Thanks daddy for accepting god in your heart before things went bad. The police are covering up their story as always. Plus u had three different cities and counties involved. They shot him once in the shoulder which spun him around. If they were that close,then why couldn't they grab him after that first shot from them. They signed up to use their guns... But how come someone kills someone and locks themselves in their home gets to walk out without no harm? I find it a little crazy
